Information on the handling of your personal data when using WhatsApp groups

Processing of personal data by us

We ourselves only use your personal data (i.e. your telephone number) to enable you to participate in the WhatsApp groups you have requested and to exchange information with other members. For this purpose, you will receive an invitation from us to the existing groups via the WhatsApp communication platforms after providing us with your telephone number. The legal basis for this is Art. 6 para.1 p.1 lit.a DSGVO as well as Art. 6 para.1 p.1 lit.b DSGVO. Within the groups, no personal data of yours will then be processed by us.

However, we inform you that within the framework of the groups both your telephone number and (if stored) your name will be displayed or transmitted to other group participants. We have no influence on whether other participants process this data or use it in any other way.

Processing of personal data by WhatsApp

we would also like to point out that WhatsApp stores and processes your personal data. Due to end-to-end encryption, WhatsApp is theoretically not allowed to access chats, pictures, voice messages and phone calls (even in the context of group chats). However, we cannot say for sure whether the service adheres to these specifications.

Nevertheless, WhatsApp also processes and collects other data (so-called metadata). This includes, for example, profile pictures, billing data, subscriber information or location data.

To exercise your right of access (Art. 15 DSGVO) and to find out what data WhatsApp has collected about you, please proceed as follows:

  • Open WhatsApp
  • Click on "Settings
  • Select the item "Account"
  • Tap on "Request account info."
  • WhatsApp will then send you a report about the collected data.

Your rights to your data

Insofar as it concerns data processed by us, you have the following rights:

  • pursuant to Art. 15 of the GDPR, you may request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, and the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;
  • pursuant to Art. 16 DSGVO, you may without undue delay request the correction of inaccuracies or the completion of your personal data stored by us;
  • in accordance with Art. 17 DSGVO, you may request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims;
  • pursuant to Art. 18 DSGVO, you may request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer need the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 DSGVO;
  • in accordance with Art. 20 DSGVO, you have the right to data transfer, i.e. to receive your personal data that you have provided to us in a structured, common and machine-readable format, or you can request the transfer to another controller, provided that the processing is based on your consent or a contract with us and the processing was carried out with the help of automated procedures. However, in the case of data transfer to another controller, you may only obtain the transfer insofar as this is technically feasible;
  • in accordance with Art. 7 (3) DSGVO, you can revoke your consent once given to us at any time. This has the consequence that we may no longer continue the data processing based on this consent for the future; and
  • pursuant to Art. 77 DSGVO, you have the right to complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our registered office for this purpose.
  • Your rights to rectification or deletion of personal data, for your request for information, the revocation of consent or for an objection is a simple message to us (huhu@creative-depot.de); Alternatively, by phone at 04148-6162600. For the exercise of your rights, you incur no costs.
